{"id":27693,"date":"2012-06-17T15:35:53","date_gmt":"2012-06-17T15:35:53","guid":{"rendered":"http:\/\/desarrollo.mcvicious.com\/aero2020\/2012\/06\/17\/presidente-del-poder-judicial-niega-haber-transgredido-la-consticion-en-caso-de-interceptacion-telefonica\/"},"modified":"2012-06-17T15:35:53","modified_gmt":"2012-06-17T15:35:53","slug":"presidente-del-poder-judicial-niega-haber-transgredido-la-consticion-en-caso-de-interceptacion-telefonica","status":"publish","type":"post","link":"https:\/\/aeronoticias.com.pe\/noticiero\/politica\/presidente-del-poder-judicial-niega-haber-transgredido-la-consticion-en-caso-de-interceptacion-telefonica\/","title":{"rendered":"Presidente del Poder Judicial niega haber transgredido la Constituci\u00f3n en caso de interceptaci\u00f3n telef\u00f3nica"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>(Aeronoticias).-<\/strong>El<strong> <\/strong>titular del Poder Judicial, C\u00e9sar San Mart\u00edn rechaz\u00f3 tajantemente haber transgredido la\u00a0 Constituci\u00f3n en torno al cuestionado caso del congresista Luis Galarreta, al indicar que por su investidura no puede intervenir en el proceso sobre interceptaciones.<strong><br \/><\/strong><\/p>\n<p style=\"text-align: justify;\">Explic\u00f3 que el juez que asume un caso, resuelve  seg\u00fan sus propios c\u00e1nones jur\u00eddicos, y el presidente del Poder Judicial  \u2018no tiene arte ni parte\u2019 en los procesos.<\/p>\n<p>Neg\u00f3\u00a0 tener  \u2018responsabilidad pol\u00edtica\u2019 en este sonado caso, ya que\u00a0 considera que este tipo de compromiso  solo la tienen los funcionarios que tienen la confianza del Parlamento.<\/p>\n<p style=\"text-align: justify;\">En declaraciones a la prensa San Mart\u00edn dijo:\u00bbEl presidente del Poder Judicial no imparte justicia. No es un caso siquiera de la Corte Suprema, es un caso de un juzgado supraprovincial en el que todos los jueces son independientes y responsables de lo suyo. Cuando fui invitado al Congreso, fui por mi voluntad, porque yo no he sido citado ni tengo responsabilidad pol\u00edtica\u00bb.<\/p>\n<p>Por ello descart\u00f3 la posibilidad de que  pueda ser acusado constitucionalmente por la decisi\u00f3n de un juez de  abrir el secreto de las comunicaciones al parlamentario Galarreta, como  lo pide cierto sector.<\/p>\n<p>\u201c\u00bfQu\u00e9 art\u00edculo de la Constituci\u00f3n he  infringido si sobre el hecho no tengo absolutamente nada que ver?\u201d,  pregunt\u00f3 el presidente de la Corte Suprema.<\/p>\n<p>Tambi\u00e9n consider\u00f3 que el juez Abel Pulido debi\u00f3 realizar un \u2018control  riguros\u00edsimo\u2019 al pedido del fiscal para levantar el secreto de las  comunicaciones, hecho que evidentemente no hizo.<\/p>\n<p>Cabe se\u00f1alar que el juez Pulido ha sido  separado de la investigaci\u00f3n al periodista Rudy Palma, cuyo tel\u00e9fono fue  intervenido por haber interceptado los correos de altos funcionarios de  los ministerios de Econom\u00eda y Comercio. <\/p>\n<p>San Mart\u00edn asegur\u00f3  desconocer si el mencionado magistrado ha sido presionado para resolver este  caso, sin embargo, aclar\u00f3, ante la presidencia del Poder Judicial y la  Corte Suprema, nadie del Ejecutivo se pronunciado.<\/p>\n<p style=\"text-align: justify;\"><img decoding=\"async\" src=\"images\/stories\/12\/06\/170612\/sanmartncesar.jpg\" border=\"0\" alt=\"pj\" title=\"pj\" \/><\/p>\n","protected":false},"excerpt":{"rendered":"<p>(Aeronoticias).-El titular del Poder Judicial, C\u00e9sar San Mart\u00edn rechaz\u00f3 tajantemente haber transgredido la\u00a0 Constituci\u00f3n en torno al cuestionado caso del congresista Luis Galarreta, al indicar que por su investidura no puede intervenir en el proceso sobre interceptaciones.
