{"id":5062,"date":"2009-09-13T16:27:27","date_gmt":"2009-09-13T16:27:27","guid":{"rendered":"http:\/\/desarrollo.mcvicious.com\/aero2020\/2009\/09\/13\/comision-de-constitucion-del-congreso-debate-despenalizacion-de-los-delitos-contra-el-honor\/"},"modified":"2009-09-13T16:27:27","modified_gmt":"2009-09-13T16:27:27","slug":"comision-de-constitucion-del-congreso-debate-despenalizacion-de-los-delitos-contra-el-honor","status":"publish","type":"post","link":"https:\/\/aeronoticias.com.pe\/noticiero\/nacionales\/comision-de-constitucion-del-congreso-debate-despenalizacion-de-los-delitos-contra-el-honor\/","title":{"rendered":"COMISI\u00d3N DE CONSTITUCI\u00d3N DEL CONGRESO DEBATE DESPENALIZACI\u00d3N DE LOS DELITOS CONTRA EL HONOR"},"content":{"rendered":"<div align=\"justify\">La comisi\u00f3n de constituci\u00f3n del Congreso de la Rep\u00fablica que preside la congresista Mercedes Cabanillas, tratar\u00e1 el pr\u00f3ximo martes el proyecto de ley del tribuno, Javier Valleriesta, respecto al proyecto de ley que busca despenalizar los delitos contra el honor.<\/p>\n<p>Dentro de este contexto se invit\u00f3 a participar a la sesi\u00f3n del pr\u00f3ximo martes a Jorge Santiesteban de Noriega, ex defensor del pueblo, Walter Guti\u00e9rrez, decano del Colegio de Abogados de Lima y Kela Le\u00f3n, Directora Ejecutiva del Consejo de la Prensa peruana.<\/p><\/div>\n<div align=\"justify\">\u00a0 <\/p>\n<div style=\"text-align: center\"><img loading=\"lazy\" decoding=\"async\" src=\"images\/stories\/09\/09\/120909\/mercedes.jpg\" border=\"0\" alt=\"Mercedes Cabanillas\" title=\"Mercedes Cabanillas\" width=\"400\" height=\"290\" \/><\/div>\n<\/div>\n<div align=\"justify\"><strong>Aeronoticias<\/strong> considera que la Comisi\u00f3n de Constituci\u00f3n debe aprobar este proyecto de ley, ya que la difamaci\u00f3n, calumnia e injuria al tener una sanci\u00f3n indemnizatoria, en el fuero civil, ser\u00e1 m\u00e1s efectiva, ya que el tipo penal vigente en la pr\u00e1ctica casi nunca se cumple, porque las sentencias son condicionales.<\/p>\n<p>Consideramos adem\u00e1s que existe el ius comunicandi, que es un derecho constitucional de igual rango al del honor, por lo que la construcci\u00f3n de una sociedad democr\u00e1tica, debe dar prioridad al derecho de informaci\u00f3n, es por ello que consideramos acertado el proyecto de ley\u00a0que busca despenalizar los delitos contra el honor, que ya algunos pa\u00edses de la regi\u00f3n han puesto en vigencia, lo que nos muestra que en el derecho comparado, la doctrina est\u00e1 avanzando en esta nueva \u00f3ptica jur\u00eddica que esperamos sea derecho positivo pr\u00f3ximamente en el Per\u00fa.<\/div>\n","protected":false},"excerpt":{"rendered":"<p>La comisi\u00f3n de constituci\u00f3n del Congreso de la Rep\u00fablica que preside la congresista Mercedes Cabanillas, tratar\u00e1 el pr\u00f3ximo martes el proyecto de ley del tribuno, Javier Valleriesta, respecto al proyecto de ley que busca despenalizar los delitos contra el honor.
