P&eacute;rez V&aacute;squez<\/strong> quien considera que como causa de la volcadura el sobrepeso que llevaba a bordo la embarcaci&oacute;n quien seg&uacute;n el experto, la misma hab&iacute;a sido proyectada para operar con 32 pasajeros a bordo, sin embargo la Direcci&oacute;n General de Transporte Acu&aacute;tico del Ministerio de Transportes y Comunicaciones, le habr&iacute;a permitido el tour con 51 pasajeros.<\/div>\n<p><\/p>\n<div align=\"center\"><strong>SOBREPESO PERMITIDO POR EL MTC<\/strong><\/div>\n<p><\/p>\n<div align=\"justify\">Debido a este sobrepeso la reserva de estabilidad de la embarcaci&oacute;n se habr&iacute;a reducido hasta los l&iacute;mites no permitidos por la normatividad internacional, seg&uacute;n este documento, que agrega que la acumulaci&oacute;n de pasajeros a una banda provoca una escora a la embarcaci&oacute;n que se ve determinada por la cantidad de pasajeros que hubo en un determinado momento, m&aacute;s a&uacute;n si la mayor&iacute;a de personas que estuvieron en el segundo nivel habr&iacute;a provocado que el centro de gravedad de toda la embarcaci&oacute;n se elevara afectando directamente la inestabilidad de la nave.<\/div>\n<p><\/p>\n<div align=\"center\"><strong>CONCLUSIONES DEBASTADORAS &hellip;<\/strong><\/div>\n<p><\/p>\n<div align=\"justify\">El ingeniero naval Carlos E. P&eacute;rez V&aacute;squez en el 7.9 de las conclusiones de su peritaje, imputa expresamente responsabilidad a BACKUS Y JOHNSTON cerveza Barena al precisar que el corrimiento de pesos a bordo genera un momento escorante que perjudica la estabilidad de la embarcaci&oacute;n.&nbsp; Los coolers conteniendo las botellas de cerveza Barena en su interior, que se ubicaron estibados en la cubierta del primer nivel se corrieron a la banda babor debido a la escora que presentaba la embarcaci&oacute;n provocado por la acumulaci&oacute;n de pasajeros a esa banda, esta acumulaci&oacute;n de peso &ndash; seg&uacute;n el peritaje &ndash; act&uacute;o como una palanca en contra de la estabilidad de la embarcaci&oacute;n Nebeska Voda.<\/div>\n<p><\/p>\n<div align=\"justify\">Esta precisi&oacute;n del perito con Registro del Colegio de Ingenieros 99898 se complementa con la declaraci&oacute;n del t&eacute;cnico electricista de BACKUS Y JOHNSTON en la embarcaci&oacute;n Nebeska Voda Wilfredo Su&aacute;rez Vargas quien un mes despu&eacute;s del accidente relat&oacute; a las autoridades que BACKUS Y JOHNSTON hab&iacute;an llevado a bordo 2 cooler de cerveza con 14 y 13 cajas de cerveza llenas con hielo con un peso aproximado de 600 kilos, mercanc&iacute;a que BACKUS Y JOHNSTON puso en la embarcaci&oacute;n en cada una de las salidas en todos los tours mar&iacute;timos que realiz&oacute; en las fechas en que este empleado de BACKUS Y JOHNSTON prest&oacute; servicios para la empresa cervecera.<\/div>\n<p><\/p>\n<div align=\"justify\">Los herederos de <strong>ZARELLA NICOLE LEZAMA DURAND <\/strong>han interpuesto una demanda civil por responsabilidad extracontractual ante el Juzgado Especializado en lo Civil del Cono Este con un petitorio de 1 mill&oacute;n de d&oacute;lares americanos, por el da&ntilde;o moral, lucro cesante y da&ntilde;o emergente contra Uni&oacute;n de Cervecer&iacute;as Peruanas BACKUS Y JOHNSTON Cerveza Barena, United Disco &ndash; Discoteca Aura &ndash; Larcomar, Aqua Tours y Corporaci&oacute;n Ballota, demanda que est&aacute; en tr&aacute;mite.<\/div>\n<p><\/p>\n<div align=\"center\"><strong>EVAL&Uacute;AN RESPONSABILIDAD CIVIL DEL ESTADO POR LAS OMISIONES DEL VICEMINISTRO DE TRANSPORTES, CARLOS PUGA POMAREDA DE AUTORIZAR A LA EMBARCACI&Oacute;N A OPERAR CON SOBREPESO<br \/><\/strong><\/div>\n<p><\/p>\n<div align=\"justify\">Los herederos de ZARELLA NICOLE LEZAMA DURAND est&aacute;n evaluando la responsabilidad del Estado Peruano en este accidente mar&iacute;timo en raz&oacute;n a que el Ministerio de Transportes y Comunicaciones a trav&eacute;s de su viceministro Carlos Puga Pomareda tienen responsabilidad por omisi&oacute;n al haber otorgado un permiso de transporte tur&iacute;stico mar&iacute;timo a la embarcaci&oacute;n Nebeska Voda permiti&eacute;ndole que transporte 51 personas cuando estaba construida para llevar solo 32, seg&uacute;n este peritaje con el agravante que el Nebeska Voda no ten&iacute;a seguro de responsabilidad civil, lo que muestra la informalidad del Ministerio de Transportes y Comunicaciones que dirige Ver&oacute;nica Zavala. <\/div>\n<p><\/p>\n<div align=\"justify\">Se tiene conocimiento que el MTC habr&iacute;a aceptado la renuncia del Director de Transporte Acu&aacute;tico, sin embargo ese hecho no exime la responsabilidad del sector por haber puesto en peligro a 51 personas y por omisi&oacute;n de sus obligaciones&nbsp; al ser responsable de otorgar autorizaci&oacute;n a Aqua Tours para que opere con sobrepeso, lo que es el nexo causal y prueba de la responsabilidad objetiva del Estado Peruano en la muerte de ZARELLA NICOLE LEZAMA DURAND, responsabilidad directa de la Ministra Ver&oacute;nica Zavala y de su Viceministro Carlos Puga Pomarada, hechos por lo que tendr&aacute;n que responder en su oportunidad seg&uacute;n nos refirieron familiares de la joven fallecida en este accidente.<\/div>\n<p>Extra&ntilde;amente, el Tercer Juzgado Penal del Callao no ha llamado todav&iacute;a a declarar a estos funcionarios del MTC.<\/p>\n<div align=\"justify\">Por &uacute;ltimo fuentes allegadas a la familia Lezama nos informan que pedir&iacute;an al congresista Jonhy Lescano que ser&iacute;a uno de los pocos que ejerce la representaci&oacute;n del pueblo de fiscalizar a ministros deficientes que pida una investigaci&oacute;n en
