471-2008-MTC\/12 en la que la DGAC del MTC aparentemente no quiso emitir opini&oacute;n oficial sobre la calificaci&oacute;n de dicho vuelo como regular o no regular, posteriormente, el MTC da una opini&oacute;n favoreciendo a la compa&ntilde;&iacute;a de seguros para que el vuelo se califique de no regular y burlarle de esta forma los derechos indemnizatorios a la viuda y a su menor hijo JORGE ARMANDO ARELLANO RUIZ de 8 a&ntilde;os de edad.<\/p>\n<p>La Fuerza A&eacute;rea del Per&uacute; a trav&eacute;s del Grupo 42 expidi&oacute; el Oficio N&ordm; NC-900-AL-42-N&ordm; 0209 del 10 de marzo del 2008 que calific&oacute; el vuelo con sujeci&oacute;n a itinerarios de vuelo, frecuencias y horarios establecidos, actuando con veracidad y en defensa de la verdad para que la viuda logre que su p&oacute;liza de seguro vida inversi&oacute;n N&ordm; U-3956 pueda ser cobrada por la beneficiaria, sin embargo, el MTC a espaldas a la Ley y con una interpretaci&oacute;n caprichosa expidi&oacute; un oficio que le priv&oacute; a un ni&ntilde;o de tener los derechos indemnizatorios que su padre le dej&oacute; al morir en raz&oacute;n a que el seguro &ndash; por esta opini&oacute;n legal&nbsp; de la DGAC- no le quiso pagar el &iacute;ntegro de la p&oacute;liza.<\/p>\n<p>La Sra. Cynthia Ruiz est&aacute; estudiando a trav&eacute;s de sus abogados el Estudio Centty, Bustamante y Asociados especialistas en aviaci&oacute;n interponer una acci&oacute;n judicial por responsabilidad
