tr&aacute;gicamente en la toma 20 del Aeropuerto Internacional Jorge Ch&aacute;vez el mec&aacute;nico de COPA AIRLINES Yuen Ou Yang Lee.<\/div>\n<p><\/p>\n<div align=\"justify\">Desde esa fecha su familia ha tenido que sortear una serie de dificultades e intentar la osad&iacute;a de demostrar ante el Poder Judicial que esta empresa paname&ntilde;a propiedad de Continental Airlines de los Estados Unidos ven&iacute;a incumpliendo sus obligaciones laborales con este profesional de la aeron&aacute;utica que habr&iacute;a prestado servicio a sus aeronaves desde el a&ntilde;o 1994.<\/p>\n<div align=\"center\"><img decoding=\"async\" src=\"http:\/\/aeronoticias.com.pe\/fotonoticias\/luis\/copa01.jpg\" alt=\"\" \/><\/div>\n<\/div>\n<p> <!--more--> <\/p>\n<p>&nbsp;<\/p>\n<div align=\"justify\">Su muerte dej&oacute; viuda y dos hijos, pero ni el dolor de una familia peruana sensibiliz&oacute; a esta empresa de aviaci&oacute;n quien le desconoci&oacute; todos sus beneficios sociales, lo que origin&oacute; que su viuda interponga una demanda laboral a COPA que termin&oacute; despu&eacute;s de un largo proceso con una indemnizaci&oacute;n de 40 mil d&oacute;lares ante el 21&ordm; Juzgado en lo Laboral de Lima, Causa 183421-2007.<\/div>\n<p>&nbsp;<\/p>\n<div align=\"justify\">Un a&ntilde;o despu&eacute;s Copa Airlines se niega a reconocerle a esta familia peruana el incumplimiento del pago del seguro de vida ley que obligaba a COPA a contratar un seguro por 32 remuneraciones por fallecimiento en accidente en cumplimiento a las normas vigentes que por supuesto COPA no cumpl&iacute;a.<\/div>\n<p>&nbsp;<\/p>\n<p align=\"center\">&nbsp;<img decoding=\"async\" src=\"images\/stories\/not1008\/copa02.jpg\" alt=\"\" \/><\/p>\n<div align=\"justify\">El Poder Judicial del Per&uacute; tiene en sus manos, &ldquo;sed de justicia de la familia de Yuen Ou Yang Lee&rdquo; que pide justicia frente a la actitud avasalladora de COPA y SWISSPORT lo que debe llevar a nuestro Poder Judicial, a merituar con equidad el comportamiento de una empresa extranjera y es por ello que el Juez del 27&ordm; Juzgado en lo Laboral de Lima es quien ya ha admitido los medios probatorios de los herederos del mec&aacute;nico de COPA fallecido de conformidad con la ley del trabajo del Per&uacute; y ha citado a la Audiencia Unica para el d&iacute;a de ma&ntilde;ana 2 de octubre del 2008, en el Local del Juzgado sito en Arnaldo Marquez 1065, 3&ordm; piso, Jes&uacute;s Mar&iacute;a.<\/div>\n<p>&nbsp;<\/p>\n<div align=\"center\"><strong>Informalidad laboral de COPA AIRLINES<br \/><\/strong><\/div>\n<p>&nbsp;<\/p>\n<div align=\"justify\">COPA AIRLINES oper&oacute; en el Per&uacute; bajo la m&aacute;s absoluta informalidad en relaci&oacute;n a sus obligaciones laborales con Yuen Ou Yang Lee, su mec&aacute;nico de los Boeing 737-800 desde 1994, no lo ten&iacute;a en planilla y le pagaban por honorarios profesionales, no le pagaban vacaciones, gratificaciones, CTS, etc, y a su muerte lo trataron de hacer pasar por trabajador de Swissport GBH PER&Uacute; para eximirse de todas sus obligaciones laborales, con la total complacencia de una Direcci&oacute;n General de Aeron&aacute;utica Civil del Per&uacute; que extra&ntilde;amente permiti&oacute; que COPA opere en el Per&uacute; durante 12 a&ntilde;os con un mec&aacute;nico trabajando en la m&aacute;s absoluta informalidad, sin embargo el principio de primacia de la realidad del derecho laboral persigue a esta empresa de aviaci&oacute;n que puede facturar mil millones de d&oacute;lares al a&ntilde;o, pero que por ahorrarse unos centavos no ten&iacute;a en planilla a quien durante tantos a&ntilde;os tutel&oacute; la seguridad de sus operaciones a&eacute;reas y la vida de pasajeros y turistas transportados en sus operaciones de y hacia el Aeropuerto Internacional Jorge Ch&aacute;vez.<\/div>\n<p>&nbsp;<\/p>\n<div align=\"center\"><strong>Estudio Jur&iacute;dico del Ministro de Trabajo defiende a COPA<br \/><\/strong><\/div>\n<p>&nbsp;<\/p>\n<div align=\"justify\">Lo interesante es que quien asume la defensa profesional de la compa&ntilde;&iacute;a paname&ntilde;a de aviaci&oacute;n es el Estudio Pasco cuyo titular hoy es ministro de trabajo del Per&uacute;, lo que nos demuestra como hacen las grandes empresas para operar en el Per&uacute; y ser ellas mismas las primeras en incumplir las normas laborales que no les alcanzan porque saben elegir a sus defensores.<\/div>\n<p>&nbsp;<\/p>\n<div align=\"center\"><strong>La prueba<\/strong><\/div>\n<p>&nbsp;<\/p>\n<div align=\"justify\">COPA gestion&oacute; un fotocheck ante Lima Airport Partners para su mec&aacute;nico Yuen Ou Yang Lee con vigencia al 23 de marzo del 2007, lo que prueba que el d&iacute;a de su muerte el 07\/10\/2006 ingres&oacute; a trabajar al Aeropuerto Internacional Jorge Ch&aacute;vez con esta credencial para desempe&ntilde;arse como mec&aacute;nico de las aeronaves Boeing 737-800 de COPA lo que obligaba a COPA&nbsp; a contratar el seguro de vida ley para su trabajador que se ven&iacute;a desempe&ntilde;ando en estas funciones desde hac&iacute;a 12 a&ntilde;os, es decir desde 1994, pero la Direcci&oacute;n General de Aeron&aacute;utica Civil del MTC permit&iacute;a las operaciones de COPA en el Per&uacute;
